Terms of service

The service

Keyworder generates titles, descriptions and keywords for photos you upload, lets you review and edit them, and exports them as CSV files or writes them into your files as IPTC/XMP metadata. Photos only; video is not supported. Generated metadata is a draft produced by an AI model. It can be wrong, incomplete or unsuitable for a given agency, and it is your responsibility to review it before you rely on it.

Your account

You need an account to use Keyworder, and you must be at least 16 years old. Keep your sign-in details secure; you are responsible for what happens under your account. Tell us at hello@keyworder.ai if you think someone else has access to it.

Credits, plans and billing

Keyworder works on credits: one credit generates the metadata for one photo. New accounts receive 5 free credits, which do not expire. Paid plans add a monthly allowance of credits (Starter: 300 a month for $5; Pro: 1,000 a month for $15). Monthly credits reset at the start of each billing period and unused monthly credits do not roll over.

Plans are billed monthly in advance through Stripe. Prices are in US dollars and exclude any tax that may apply. You can cancel at any time from your account; your plan then stops renewing at the end of the current billing period. We may change prices with at least 30 days’ notice by email; the new price applies from your next renewal after that notice.

Refunds

Credits that have been used are not refundable, because the work they paid for has been done. If a batch went wrong, if you were charged in error, or if something else is not right, email hello@keyworder.ai and we will look at it; where a problem is on our side we will put it right, which may include re-crediting your account or issuing a refund.

Your photos and your metadata

You keep every right you have in the photos you upload and in the metadata generated for them. You give us only the permission we need to run the service: to store your photos for up to 30 days, to send a resized copy for analysis, to show your photos and metadata back to you, and to write metadata into files you download. We do not use your photos or metadata to train machine-learning models and we do not share them with anyone except the processors listed in our privacy policy.

Photos are deleted automatically 30 days after upload. Keep your own copies; Keyworder is not a backup service.

Acceptable use

You agree that you will:

• only upload photos you own or have the rights to use and to have described;
• not upload anything unlawful, including content that infringes someone else’s rights or depicts abuse;
• not try to break, overload, reverse-engineer or gain unauthorised access to the service;
• not resell access to Keyworder or use it to build a competing service by scraping its output at scale;
• comply with the rules of any agency you submit metadata to.

We may remove content, suspend or close an account, or refuse service if we reasonably believe these terms are being broken. Where practical we will tell you first.

Availability and changes to the service

Keyworder is a young service and is offered as a beta. We aim to keep it running well, but we do not guarantee any level of uptime, that generation will always succeed, or that any agency will accept the output. We may add, change or remove features, and we may need to take the service down for maintenance. If we ever decide to shut Keyworder down we will give at least 30 days’ notice so you can export your work.

Disclaimer and limitation of liability

The service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent the law allows, RSTJ Tools LLC is not liable for any indirect, incidental or consequential loss, including lost revenue, lost sales or rejected submissions, arising from your use of Keyworder. Our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose. Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits.

Ending the agreement

You can stop using Keyworder at any time and ask us to delete your account by emailing hello@keyworder.ai. We can end the agreement if you break these terms or if we withdraw the service, as described above. Sections about your content, refunds, liability and governing law survive the end of the agreement.

Changes to these terms

We may update these terms from time to time. The current version is always at keyworder.ai/terms with its effective date. For changes that materially affect you we will email account holders at least 14 days before they take effect. Continuing to use the service after that date means you accept the new terms.

Governing law and contact

These terms are governed by the laws of the State of Delaware, USA, as applicable, and any dispute will be heard in the courts located there, unless the law where you live gives you the right to bring it elsewhere. Questions about these terms: RSTJ Tools LLC, hello@keyworder.ai.
